These terms are an agreement between you and Pennywise App Studio ("we"), the maker of Switchyard, a desktop Git client for Windows. By installing or using Switchyard you agree to them.
1. Who sells it
Our order process is run by our online reseller, Dodo Payments, who are the merchant of record for all our orders. Dodo Payments takes the payment, handles taxes, issues the invoice and deals with payment enquiries and returns. When you buy, you also accept Dodo Payments' own buyer terms, shown at checkout.
2. The trial
Each computer gets one free trial, currently 30 days, starting the first time Switchyard opens on it. The trial includes every feature. Creating new accounts, reinstalling or altering the app to get more trial time is not allowed. We may give extra free days as a promotion; a promotion's own conditions say who it is for and how long it lasts.
3. Subscriptions
- Switchyard is sold as a monthly or a yearly subscription, at the price shown on the pricing page when you buy. It renews automatically at the end of each period until you cancel.
- A price change never applies to a period you have already paid for. We will tell you before a new price applies to your renewal, and you can cancel before it does.
- If a renewal payment fails, Switchyard keeps working for 3 more days while it is retried. After that, it becomes read-only until the payment succeeds.
- You can cancel at any time; the subscription then runs to the end of the period already paid for. Refunds are covered by the refund policy.
4. Your licence
- A subscription gives you a personal, non-transferable licence to use Switchyard on one computer at a time. You may move it to another computer you use, a limited number of times a month.
- Keep your licence key to yourself. Sharing, selling or publishing it is not allowed, and a key that is shared may be disabled.
- You may not copy, resell or redistribute Switchyard, or reverse engineer, modify or bypass its licensing, except where the law allows it regardless of these terms.
- When a trial or subscription ends, Switchyard becomes read-only: you can still open and read your repositories, but not change them through the app. It never deletes, moves or changes your files because a plan ended.
5. Your code and your data
Switchyard works on repositories on your computer, using the git installed there. Your code, file names, branch names and repository contents are never sent to us. What the app does send, and what we keep, is set out in the privacy policy.
6. Updates and the safety switch
Switchyard updates itself. If a version is found to be faulty, we may make that version read-only or stop it until you update, to protect your repositories. This never deletes or changes your files.
7. No warranty
Switchyard is provided "as is". We work hard to make it safe (every destructive action asks first), but we do not promise it is free of defects. Git operations change repositories: keep backups and use a remote for work you care about.
8. Limit of liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profits or business, arising from your use of Switchyard. Our total liability to you for any claim is limited to the amount you paid for Switchyard in the 12 months before it. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer where you live.
9. Ending the agreement
You can stop using Switchyard and cancel at any time. We may end or suspend a licence that breaks these terms, for example a shared or resold key. If we stop selling Switchyard, we will give at least 30 days' notice and refund any unused part of a yearly subscription.
10. Changes and contact
We may update these terms; the date at the top says when they last changed, and a change that matters to a subscriber will be announced in the app before it applies. Questions: pennywise.appstudio@gmail.com.
